How do I submit a notice of opportunity to compete to purchase or a notice of closure?
Effective July 23, 2023, manufactured/mobile home community owners are required to give written Notice of Opportunity to Compete to Purchase their manufactured/mobile home communities or the properties on which they sit. Community owners must provide these notices to community tenants, qualified tenant organizations, the Department of Commerce (Commerce), and the Washington State Housing Finance Commission. Commerce is required to provide these notices to eligible organizations.

New changes required by the passing of SSB 5298. Every six months from the date of delivery of a notice until sold or no longer for sale or actively listed, the owner must provide Commerce with an update on the status of the notification and the sale. - Download a Notice template (PDF) to send to Commerce via email at omh@commerce.wa.gov

All Notice submissions are subject to public disclosure pursuant to RCW 42.56.
Commerce will not post community owners or representatives’ addresses on its webpage or attached documents; however, we will post names and email addresses associated with each community.
The Opportunity to Compete to Purchase map visually displays the location of Commerce approved Notices of Opportunity to Compete to Purchase submitted by community owners or their representatives. Each blue map point represents an approved Notice and includes the following information: community name, date notice given to residents, Commerce notice approved date, community address, community owner/representative name, and community owner/representative email address. Sale status of communities for which the program receives Notices may change. Please contact the community owner or representative directly for information about community status.
The Closure Notice to Tenants Template (Notice) must be used by landlords closing or converting their manufactured/mobile home community. Please see Chapter 38, Laws of 2023 (E2SSB 5198) – Manufactured/Mobile Home Communities – closure or conversion, and RCW 59.20.080 for exemptions to the two year Notice requirement. The Notice is available upon request in printed form by contacting our office at 800-964-0852 or OMH@Commerce.wa.gov. Document translations are provided by a Washington State Department of Enterprise Systems’ approved vendor.
The closure notice required by RCW 59.20.080 before community closure or conversion must be given to the Director’s designee and all tenants in writing.

- Contact program staff for additional information, including a physical mailing address if preferred.
- RCW 59.20.080 (1) (e) (iv) and (v) allow community owners exemptions from the two-year community notice of closure requirement if they provide certain types and amounts of relocation assistance to tenants. The Department of Commerce (Commerce) is required to provide instructions in the notice to vacate informing tenants how to contact Commerce for information about the availability of financial and technical assistance programs available to support eligible tenant relocation activities.

A Manufactured/Mobile Home Community (Mobile Home Park) Registration is required of all manufactured and mobile home parks that offer 2 or more spaces (lots) in the park for rent or lease for year-round occupancy. Community owners are required to register and pay annual fees.
The fees support the Attorney General’s Office who administer the Manufactured Housing Dispute Resolution Program (enforces the Manufactured/Mobile Home Landlord-Tenant Act) and partial reimbursement of community owner expenses to demolish and dispose of homes of eligible tenants in closing manufactured/mobile home communities.
Community owners can verify contractors, tradespersons, and businesses with the Washington State Department of Labor and Industries (including certified asbestos contractors) and the Washington State Department of Revenue when planning to demolish and dispose of manufactured/mobile homes.
