Where can I view copies of the proposed WACs?
Click below to see the proposed rules.  The proposed rules will be published in the Washington State Register on August 5, 2009.  Further announcements will go out when this date approaches.

    Which WAC sections are proposed for rule-making?
    Commerce will review those portions of the administrative guidelines that were adopted in 1991 and 1992. 
     
    This includes WAC 365-195, Procedural criteria for adopting comprehensive plans and development regulations and WAC 365-190, Minimum guidelines to classify agricultural, forest, mineral lands and critical areas. 
     
    In addition, Commerce proposes to repeal WAC 365-195-010 thorugh 365-195-865 and create a new chapter 365-196 for these amended sections.  This new chapter will allow for re-organization of the WAC and better clarity.  The remainder of chapter 365-195 WAC will be renamed to better reference those sections remaining in that chapter without change.
     
    This proposed rule-making does not include
    WAC 365-197, Project Consistency or WAC 365-195 (Part Nine), Best Available Science, adopted in 2000.
     
     
    How did Commerce decide which rules to amend?
    Commerce is prioritizing its review and update of the administrative guidelines based on the following:
        (1) Review of amendments to the GMA since its original adoption, which have not yet been incorporated into the WAC. 
        (2) Incorporation of significant clarifications of the statute by the courts and the Growth Management Hearings Boards.
        (3) Consideration of comments heard from stakeholders.

    When is the comment period?

    The comment period for the proposed rule is open until Ocober 2, 2009.
